When working with Info Carioca Web Design Company as a client, you must agree on the following terms and conditions:
Contract Terms
Info Carioca web Design Company is creating a quote for a project after receiving a description of specifications and requirements about the project from the client, in verbal or written ways. Both parties will estipulate a date when the client will confirm if the quote was accepted. The quote will be the basis of the contract.
All the statements from the project must be clarified at this time. Both parties are going to make an agreement in which each one confirms that they agree with all terms estipulated. The contract must be clear and both parties must not keep any inducement not recorded on this agreement.
Copyright and Content
The website and content used to represent Info Carioca Web Design Company on the Internet is registered as Info Carioca's property and protected as trademark by copyright laws. All content, including but not limited to information, text, data, messages, software, applications, media, music, sound, photographs, animations, graphics, video, and other information and materials found on the Info Carioca website ("content") is either Info Carioca's property or that of a third party owner, signified by its trademark notice. The partial or total reproduction is prohibited unless by a written and recognized authorization from the owners. You may not sell, rent, lease, sublease, copy, license, reproduce, transmit, mirror, modify, distribute, publicly display, publish, adapt, edit, participate in the transfer or sale, or create derivative works from any content, whole or in part, without prior written authorization from the owners. All copyrighted material, trademarks and other proprietary information will be respected.
You may use the website for lawful purposes only. The website may not be used to post or transmit any material that violates or infringes in any way upon the rights of others. The website may not be used for anything that is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, prejudicious or otherwise objectionable. Client's logos, corporative identity, artwork, graphics, text and photographs remain the Copyright of the client. Design, graphics and programming produced by Info Carioca remain the intellectual property of Info Carioca unless otherwise agreed. Copyright of any CGI, PHP applications or javascripts within the website will remain the property of Info Carioca for the duration of the websites existence and may not be modified or reused without the express permission of Info Carioca.
Info Carioca reserve the right to refuse publication on the web of any content if it is against the company policies or if it's considered offensive or prejudicious towards others.
Website Design
Samples of the work in progress will always be provided by Info Carioca for the client's approval. The design copyright of the samples remains the sole property of Info Carioca, not being available for any publication or reproduction without authorization. Use of the design in any respect without the express written permission of Info Carioca will constitute breach of copyright.
Info Carioca will deliver website code and graphics to the client when payment of the final invoice for the agreed quote value is received in full.
Invoicing, Payment and Validity
The quotes are valid for 30 days from the date of the Quote, except when validity date is specified by Info Caroca. All prices quoted may be subject to change without notice after this period or if the project is reviewed or if the client makes new demands during the work.
Payment for the services must (unless otherwise agreed in advance with Info Carioca) be made as follows: 40% in advance, next 30% after approval and final 30% after completion of the project but before uploading. Any other design modifications will be a charged extra, unless if specified by Info Carioca and agreed by both parties.
Info Carioca charges a cancellation fee of 60% will apply if the contract is terminated through no fault of Info Carioca. An interim invoice will also be levied for 75% of the total quotation value if website content is not received at the determined time.
The final invoice will be issued when work has been completed on the client's website design. Website code and graphics will not be released to the client until payment is received in full. Any further modifications to the website will be chargeable under separate terms.
